Can I sell a theme I make using Artisteer and using a photo from BillionPhotos?

Yes, you can sell theme with photos from BillionPhotos to individual customers. But you cannot resell such themes on theme stocks, for example.

But can my own Artisteer created themes with photos from Billion Digital/Billion Photos be sold to each single client for use with that clients website?

I was not totally sure, but somewhat expected your reply, as you said, it's fairly common. It's okay to create one theme for a client, but not okay to create a theme and then sell it as a mass sale product using the imagery. It makes sense because the market would be saturated with the photos, so it's best to use them sparingly as per one or two client sites.

I found a great free photo site called Morgue File that I'm using images from. So far, I found almost a hundred photos of coffee and people to use to create a coffee shop theme for sale, so I'm good and understand the policies. Thank you for clarifying.

And this is not only billionphotos limitation.
I am not sure if you can find any commercial photobank that allows resale.

For example let's look at istockphoto.com.

Usually resale requires extended license that costs from $50 per photos.

Hi,

You can sell themes to your customers,
but you cannot upload images or themes with images to another website for download (redistribute).
See #15: http://templates.themler.com/Agreement.

This is standard license Agreement for any website with images.
